Q3. l have got a job offer for food packaging industry / meat industry through one agency and I am currently in India. Agency is asking money(anything around 1-5 lac Rs) for migration and after 6 months they offer TRC also. Is it real or worthy to come ?

Beware of many fraud agents who would promise you give a job in Poland with valid work permit and TRC in future. They will ask you give 3-4 lac rupees or even more to process your visa, work permit and give you a job in packaging factory, meat factory or some other blue collar job. In reality, you will get such job but it will be very hard for you to save / recover the money you have spend already for coming to Poland.

You have a number of different types of contracts (umowa) in Poland. The most common ones are:

  1. Umowa o pracę (contract of emplyment)- a job contract that entitles you to benefits such as paid holidays, company paid ZUS (healthcare) payments.

    1. Employees are entitled to some benefits described in the Labour Code (e.g. paid holidays)

    2. Employer is obliged to pay your social contributions

    3. Protection in case of contract termination (only in case if your contract is for unlimited time, in other cases employer can fire you without giving reasons)

    4. Minimum wage guarantee

    5. Can be concluded: for a trial period, for an indefinite period, for a definite period (including for the purpose of replacing an employee).

There are also, however, some cons to contracts of employment:

      • Reduced flexibility (specific time and place of performing work)

      • Impossible to delegate your work to subcontractors

2. Umowa zlecenie (contract of mandate):

Pros of contracts of mandate:

  • possbility to delegate work to a subcontractor;

  • freedom (limited employer supervisory over tasks delegated to an employee);

  • short notice (unless prearranged otherwise with an employer);

  • higher salary for students younger than 26 (no obligation to pay healthcare contributions by an employer).

  • Compulsory insurance: health, pension, disability pension and accident insurance (Article 6 paragraph 1 item 4, Article 12 paragraph 1 of the Act of October 13, 1998 on the social security system and Article 66 paragraph 1 point 1 letter e of the Act of 27 August 2004 on health care services financed from public funds). Additionally, on a voluntary basis, the contractors can join the sickness insurance, but only on condition that the social contributions are obligatory.

  • regulated by Civil Court

Cons of contracts of mandate:

  • no privileges coming from the Labour Law (paid holidays, paid overtime etc.);

  • no maternity, paternity or sick leave or pay for downtime

  • no accident insurance or severance pay;s

  • short notice (unless prearranged otherwise with an employer);

  • smaller access to e.g. bank loans.

  • It can be concluded in any way, including verbally and even implicitly.

  • The period of work on the basis of a contract of mandate is not included in the work period, unless in-company regulations provide otherwise.

3. Umowa o dzieło (contract of work):

  • given only for specific work

Cons of contracts of mandate:

  • no privileges coming from the Labour Law (paid holidays, paid overtime etc.);

  • no maternity, paternity or sick leave;

  • no accident insurance or severance pay;s

  • short notice (unless prearranged otherwise with an employer);

  • no access to e.g. bank loans.

  • no social insurance

Ask specifically what you will be provided

Q5. What means in Salaries: netto (net, in hand, after taxes), brutto (gross, before taxes) ?

In most jobs you will be quoted the brutto (gross amount).

For an umowa o pracę, you should get about 66% of your brutto as netto (in hand). This does include ZUS payments by the company. The company deducts your taxes and gives you the netto.

For or umowa zlecenie its quite similar then umowa o pracę, only differences are in benefits and sick insurance (voluntary).

For umowa o dzieło your brutto is what you get in hand + VAT (if applicable). You have to pay by your own all taxes.

You can calculate your salary after taxes here.

Q6. Do I get health insurance from employer ?

In general as an employee you are covered by Govt Insurance called ZUS. It is mandatory here in case of umowa o pracę (other agreements is always voluntary). It is like Indian Government Hospitals but a better version.

Many employers are offering private insurance. If you are used to private hospitals back home, then try to get insurance from your employer (if possible).
